Import & Export Disputes

Representing Your Business in UCC and CISG Claims in Los Angeles

With the growing internationalization of manufacturing, wholesale and retail businesses, an increasing number of business-to-business disputes involve the import or export of goods. At the law firm of Mathew & George in Los Angeles, our lawyers have extensive experience handling these claims for clients in Southern California. Many of our clients are in the textile, apparel and fashion businesses.

Import and export disputes typically involve ordered goods that were either not delivered, or the delivery was untimely or nonconforming in terms of quality or quantity. Remedies typically involve money judgments. To the extent a foreign company has assets in accounts receivable in the United States, that money can be attached and collected by our lawyers. Other remedies may include:

  • A reduction in price if some of the goods are salable
  • Fees and offsets for custom duties
  • Not accepting delivery

Cases involving the sale of goods can be complex and involve multiple parties in the United States and internationally. When a claim involves a domestic business, the Uniform Commercial Code (UCC) applies. For imported goods, the Convention on Contracts for the International Sale of Goods (CISG) applies.

It's not unusual for a business to be involved in more than one legal action over the same issue. For example, a wholesaler may sue you for breach of contract because you were unable to deliver goods promised to you from an overseas company. In a situation like this, our lawyers would defend you from the breach of contract claim, while pursuing a claim against the overseas company.

Since many of the companies that manufacture goods are located overseas, our lawyers often handle import/export claims in federal court. We have helped businesses settle claims involving millions of dollars.
