In California, lawsuits over real estate fraud have increased in recent years. This increase can be blamed in part on a depressed real estate market. When a house or commercial property does not appreciate as it did in the past, but instead declines in value, then the damages caused by fraud are greater.

  • Misrepresenting the condition of residential or commercial property. For example, the seller of a commercial property may not disclose (and may even try to hide) structural damage or major mechanical problems.
  • Misrepresenting the revenues of a property such as a hotel or motel.
  • Failure to disclose mold, roof damage or water damage to a property.
  • Forging real estate deeds.
  • Deceptively adding the name of the seller, broker or other third party to a real estate deed. In this situation, the seller or broker would become the sole owner of the property if the buyer died, shutting out heirs who should rightfully inherit the property.

Many real estate contracts sell the property "as is," giving you as the buyer the duty to conduct your own investigation. However, this disclaimer is not absolute. Our lawyers can look beyond that language in the real estate contract and establish fraud.
