What is Wrongful Termination?
Wrongful termination is a term used when an employee is laid off for an illegal reasons in the eyes of the law. It described a situation which an employee’s contract of employment is violated by their termination. The terms of wrongful dismissal can vary by contract and jurisdiction but the absence of a formal contract does not mean you do not have a wrongful termination case.
If you were discriminated against due to race, nationality, religion, or sex then this falls under wrongful termination if you were also fired due to these circumstances. Retaliation from an employer because you filed a discrimination claim is also part of a wrongful dismissal case. Nor can an employer fire you for not participating in an illegal activity and they must follow procedures to rightfully terminate an employee.
